Canada Start-Up Visa: Eligibility and Requirements

Canada Start-up Visa is a Federal program designed for innovative entrepreneurs with the potential for starting a business that can create jobs for Canadians and compete on a global scale. This visa program aims to provide a fast-track permanent residence for foreign entrepreneurs who can meet its eligibility requirements. 

 To qualify, you must meet all four eligibility and admissibility requirements to migrate to Canada. As an entrepreneur, you must have a qualifying business, a letter of support from a designated organization, good language ability, and enough money to start in the country. 

A qualifying business is a business where you have at least 10% or more of the voting rights in shares and other important factors. You must also obtain a letter of support from established organizations to fully validate your application. These designated organizations include Venture Capital Firms with a minimum investment of $200,000, Angel investor groups with at least $75,000 investment, and business incubators. 

 Applicants for a Start-Up Visa must also take a language proficiency test from an approved agency. You must be able to meet the minimum level in four language skills namely: speaking, reading, listening, and writing, based on the Canadian Language Benchmark for English or French. 

 Along with your language results, letter of support, and qualifying business, you must also show proof that you have enough money for you and your family to settle in Canada. This is because the Canadian government does not provide any financial assistance for start-up visa immigrants. It is important to remember that the funds required may vary depending on your family size. For instance, a family size of one must have at least Can$ 13,213 to get application approval. 

Note that your Canadian Start-Up Visa may take at least 12-16 months to process.

As an alternative, Canada also offers programs that allow investors or business owners to apply for a work permit, which potentially could lead up to obtaining permanent resident status.

Canada Work Permits for Business Owners and Investors

The Canada Work Permits/ Visas available for business owners or Investors are options for people who have a business to bring into the country, or for those who can start a business or franchise, buy an existing business, or open a business branch in Canada. 

These programs have several benefits to entice business-minded individuals to immigrate to Canada and are available through several Provincial Nominee Streams and Federal options. Among them we can find:

  • Provincial Entrepreneurial work permits: these are point based systems that normally require a minimum investment and take into account the amount of your investment, your background, the number of Canadians that will be hired, the region you intend to settle your business in, among others. Through this work permit, you could potentially be nominated by the province to obtain your PR.
  • Owner - Operator LMIA work permit: to be eligible, the investor is required to buy an existing Canadian business or to set up a new business in Canada as well as submit a Labor Market Impact Assessment (LMIA) along with a business plan. If a positive LMIA is issued, the investor applies for a renewable work permit.
