EB5 Visa – Plan B for applicants

So many applicants in the EB5 queue had to go through the horrific experience of the largest EB-5 escrow agent in the US, Signature Bank going under and being bought out by a rival bank. The Federal Deposit Insurance Corporation only insures limits of only US$250,000, leaving most of the US$800,000 EB5 investor’s funds exposed, and creating a lot of uncertainty now and into the future. USA EB5 Visa

Here is a quick crash course in the infamous US-based EB-5 program: it’s an employment-based fifth preference visa that participants receive which was created in 1990 by the US government. It’s an economic stimulus program that allows overseas applicants to invest in pre-approved government projects which meet the requirements of job creation for the specific regions of the country - in exchange the overseas immigrant applicant receives a green card with attached conditions.


It costs US$800,000 minimum, the processing times for EB-5 I-526 Immigrant petitions are from 29.5 to 61 months as of May 2023. That’s expensive, and long, in addition to the uncertainty of US banks, and don’t forget the 5-year residency requirement in the US after you’re a green card holder to obtain US citizenship & passport. Our math isn’t great, but it sounds like it could take 7-10 years at least - and that’s if the US banks don’t default, and your EB-5 investment project is actually completed and successfully meeting the conditions of your green card.

Plan B for the USA EB5 Visa

It may not be called the EB-5 Canada program, although it’s the same concept, but much better. In the US EB-5 program, you invest in pre-approved government projects in the country. In Canada, you invest in an eligible active and operational business inside the country.


In the US EB-5 program, you must go through a fine comb with your source of funds and accumulation of wealth. In the Canadian program you just need minimum settlement funds and show that you’ve had it since the time you applied (We’re talking about $15,000 to $30,000 Canadian dollars depending on your family size) - peanuts compared to the US EB-5 requirements.


In the US EB-5 program, you may be from a country where the processing queue is long and can take years before your green card is issued. In Canada, if you invest in an eligible business, meeting the provincial program requirements, you can be sponsored as an executive, manager, or professional for that company within months, and apply for your permanent residency directly from overseas - no matter which country you are from.


In the EB-5 program, you must invest a minimum of US$800,000 in one shot. In Canada, your investment can range from US$ 80,000 to $150,000.


It’s simple, you invest in a minority share in an operational eligible business inside Canada within the province of your choice or the one you are eligible for, and the company sponsors you as a minority stakeholder executive or professional to arrive in Canada on a PR, and sometimes even a work permit - depending on the program.


You may ask, what about language ability and education? Aren’t those mandatory for Canadian immigration? Not all provinces require language proficiency exam scores, and education is not mandatory in all programs. If you have documented proof of management or work experience matching your proposed role in the Canadian entity - it’s possible. There are at least 5 provinces in Canada where this is possible.


You may ask, what about Express Entry - I’m not eligible - so what should I do? Our answer is that you don’t need Express Entry for these programs. It’s purely optional.
