Francophone Mobility Program – NO LMIA required under the International Mobility Program (IMP) C16

Facts about the Francophone Mobility Program

* The language of work does not need to be French, meaning the employer does not need to be able to communicate in French.

* Any TEER skill level occupation (0-5) is eligible to apply, except for the primary agricultural worker.

* Previously, this program was based on the IRPR R205(a) which required significant cultural, social, or economic benefit to Canada to become eligible. The requirements were much stricter with higher language requirements, lower approval ratings for work permits, and limited allowed skill levels for TEERS 0– 3.  

* According to the minister’s instructions under the new program, eligibility is considered “as necessary for public policy reasons related to the competitiveness of Canada’s academic institutions or economy.”

Francophone Mobility Program - Eligibility to Apply as of June 15th, 2023

Applicants need to possess the following requirements to be eligible to apply: 

* A job offer from outside of Quebec. This can be from anywhere else in Canada. Primary agricultural work does not qualify for this.

* A CLB 5 equivalent in speaking and listening (not reading and writing) in a French language exam. OR proof that you have previously studied or worked in French.

Employer Requirements for the Francophone Mobility Program

Employers interested in qualifying for the program must complete the following steps:

* Issue a job offer based on a reasonable wage rate for that position in the province of work. 

* Request the LMIA exempt code for the job offer and work permit application.

* Since this is an LMIA exempt program the employer compliance fee is only $230. This process literally takes only minutes.

* Provide proof of operations, payroll, and income to justify the hire and the position. 

* Identify the work location for the job offer and the foreign worker.



Francophone Mobility Program – Work’s permit duration

The duration for the work permit under the C16 LMIA exempt permit code is based on whichever of the following dates is earlier: 

* The expiration date of the foreign worker’s passport OR 

* The duration of the job offer issued by the employer.

Family members and dependents for the Francophone Mobility Program

* Dependent children of the main applicant can apply for study permits.

* Spouses and common-law partners are also eligible for a spousal open work permit for the duration of the validity of the main applicant’s work permit.
