Meaning applicants are now exempt from the requirement to be in status and the requirements to not be inadmissible due to a lack of status. The objective of this new policy is to help keep families together in cases where genuine spouses and common-law partners are already living together in Canada. It also aims to prevent hardship from separating couples who are already living together in Canada. What is “lack of status”?

The policy on sponsoring “lack of status” spouses or common-law partners include:

  • Persons who have overstayed a visa, visitor record, work permit or student permit;
  • Persons who have worked or studied without being authorized to do so under the Act;
  • Persons who have entered Canada without the required visa or other document required under the regulations;
  • Persons who have entered Canada without a valid passport or travel document (provided valid documents are acquired by the time CIC seeks to grant permanent residence).

Do you qualify as a sponsor?

You can sponsor your spouse, partner, or dependent child if:

  • You’re at least 18 years old
  • You're a Canadian citizen, a permanent resident of Canada, or a person registered in Canada as an Indian under the Canadian Indian Act - There are many ways to achieve your permanent residency card (PR) in Canada, whether in Ontario, Nova Scotia, or Vancouver. To become a permanent resident in Canada, you need to create your Express Entry profile, have enough CRS points to be eligible in one of the immigration draws. The good news is that there are more than +70 programs available for immigration applications to be successful in Express Entry draws, from Provincial Nominee Programs (PNP) to Federal Skilled Works (FSW) programs.     • If you’re a Canadian citizen living outside Canada, you must show that you plan to live in Canada when the persons you want to sponsor become permanent residents.
    • You can’t sponsor someone if you’re a permanent resident living outside Canada.
  • You're able to prove that you’re not receiving social assistance for reasons other than a disability
  • You can provide for the basic needs of any persons you want to sponsor

Processing times and fees 

Due to the impacts of coronavirus disease (COVID-19), IRCC is unable to process applications normally and provide accurate processing times. However, applications from Canadians trying to return to Canada, vulnerable people, and people who perform or support essential services will be a priority. Government Fees to sponsor your spouse or partner are currently $1050 and $150 per dependent child.
